Regulatory Programs for Transportation Fuels in CA and OR

California and Oregon both have regulatory programs that set requirements for carbon intensity of transportation fuels and include specific reporting and verification requirements for reporting entities. The Low Carbon Fuel Standard (LCFS) is a program initiated in 2009, which is administered by the California Air Resources Board (CARB). In Oregon, the Department of Environmental Quality (DEQ) administers the Clean Fuels Program (CFP). This program was initiated in 2016 and shares many similarities to the LCFS which it was based on. These programs set standards for average carbon intensity that regulated parties must meet, in order to meet targeted reductions.The CFP and LCFS programs may apply to any organization selling, supplying, or producing transportation fuels for in-state use.

What are the Verification requirements?

  • In general, verification by an accredited verification body (VB) is required for alternative liquid fuel producers and importers, certain fuel exporters, reporters of propane and NGV fueling, fuel pathway holders with site-specific CI data, and specified source feedstock suppliers with site-specific CI data.

  • Verification is a new requirement for the CFP, applicable starting with 2021 calendar year data submitted beginning in the spring of 2022.

  • Key deadlines for both programs include Annual Fuel Pathway Reports and Annual Compliance Reports due by April 30. Verification Statements for Fuel Pathway Reports and Quarterly Transactions Reports are due by August 31.
